Please read this agreement. By installing or using the Software you agree to it. If you do not agree, do not install or use the Software.
1. Personal Use Is Free
You may install and use the Software at no charge for Personal Use. "Personal Use" means use by an individual for their own non-commercial purposes: hobby projects, learning, study, and managing servers they own or administer for themselves, including a home lab. Use by a registered charity or an educational institution for teaching also counts as Personal Use.
2. Commercial Use Requires A Licence
Any other use is "Commercial Use" and requires a paid licence from Amiplay for each user. Commercial Use includes using the Software:
- in the course of a business, profession, employment, or consultancy, including administering servers for an employer or client;
- on equipment owned or provided by a business; or
- to generate revenue directly or indirectly.
A licence covers the named user, who may install the Software on up to four of their own devices. Pricing and purchase are available at sshcommand.com. A business may not satisfy several users with one licence.
3. What You May Do
Subject to this agreement we grant you a non-exclusive, non-transferable, revocable licence to install and run the Software for Personal Use, or for Commercial Use if you hold a valid licence for it, and to make one copy for backup.
4. What You May Not Do
You may not, and may not allow anyone else to:
- copy, sell, rent, lease, sublicense, or redistribute the Software, or offer it as a hosted or managed service, except as we expressly allow in writing;
- reverse engineer, decompile, or disassemble the Software, or attempt to extract its source code, except to the extent applicable law permits despite this restriction;
- modify the Software, or create derivative works from it;
- remove, disable, or circumvent any licence check, notice, or limitation;
- use the Software to access systems you are not authorised to access, or for any unlawful purpose.
5. Ownership
The Software is licensed, not sold. Amiplay and its licensors own all rights, title, and interest in it, including all intellectual property. No rights are granted except those stated here. The name "SSH Command", its logo, and Amiplay's marks are our trademarks.
6. Third-Party Components
The Software includes third-party open-source components, each under its own licence, which are listed in THIRD_PARTY_NOTICES.txt. Those licences apply to those components and do not affect this agreement for the Software as a whole.
7. Your Data and Credentials
The Software stores saved logins on your device, in a vault encrypted with a master password that only you know. We cannot recover that password or your saved logins, and you are responsible for keeping them safe and for keeping backups. The Software connects only to the servers you tell it to connect to. You are responsible for the servers you connect to and for complying with the terms and laws that apply to them.
8. Updates and Versions
A Commercial Use licence is perpetual: you may keep using every version of the Software released while your update period is active, for as long as you comply with this agreement. Your licence includes all updates released during the 12 months after purchase. After that period you may continue to use those versions, and may renew to receive later versions. Updates are governed by this agreement unless they come with their own terms. We may change the features included in Personal Use and Commercial Use licences for future versions.
9. No Warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. The Software performs privileged and destructive operations on remote systems (such as deleting files and changing permissions or ownership) on your instruction. You are responsible for backups and for checking what you ask it to do.
10. Limitation Of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMIPLAY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING FROM OR RELATED TO THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM (OR ZERO FOR PERSONAL USE). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Termination
This agreement lasts until terminated. It ends automatically if you breach it. On termination you must stop using the Software and delete all copies. Sections 4, 5, 9, 10, and 12 survive termination.
12. General
This agreement is governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law rules, and the courts of Thailand have exclusive jurisdiction, except where your local law requires otherwise. If any part is unenforceable the rest remains in force. This is the entire agreement about the Software and replaces earlier understandings. We may update this agreement for future versions; the version that came with your copy applies to that copy.
